I think the things you are asking for are very reasonable and are important for the entire futures industry. If these
provisions are not in place and effectively applied to protect customers, the integrity of the entire system and of individual brokerage firms
is highly questionable and does not create an attractive environment for encouraging farmers and others to use the available
risk management tools. That in turn would raise questions regarding what is the purpose of the market, if it is not
primarily for risk management.

Proposal for change to commodity broker regulation rules and enforcement
1. Broker follow the rules of the contract market that the commodities are traded on
A. my contracts where soybeans and traded on Chicago Board of Trade Broker said he was not member of that exchange so he did not have to abide by ther rules of that exchange
2. All rules are enforced on brokers and customers alike
A. Broker stated that the NFA rules where mostly for the customer to follow not brokers
3. When customer files complaint investigator will meet with customer acquire all facts statements Including documents that are proof of the complaint
A. Investigator never met with me and got my full story or reviewwed my documents that I could of provided to them
4. Investigator will document brokers version of the event His explanation of customers complaint and provide copy of said version with his documents to customer for review
A. I was never provided the brokers version of story and was told I could not get it was non public information
5. Customer shall have right to rebut brokers version or ask for hearing before there is findings of investigation (decision)
A. I never knew the brokers version so had no oportuinty to rebut his version which I still do not know
6. Customer shall be provided with findings of the investigation (decision)
A. I was never provided findings actually was never contacted back by investingator
But the Broker said later he was told by investigato to more stricter adheere to the NFA rules
7 Findings can be appealed much like a administration review in other regulatory venues
A. I was told I had no appeal rights to the descion
8. Investigation should done in speedy process
A. My process has been going on for 5 yrs
9 Investigators will work with officials if there is criminal activities involved (perjury)
NFA has refused to proved information to other officials
10 Brokers can be held responsible for damages caused by wrongful activities / actions
Commodty Brokers are not lisc by your state or any one merely Regualted by Their on membership
Association The National Futures Association
Talk about this with your farm organization other farmers congress man make discussion
Farm groups like farm bureau only respond to thier member concerns (they say )
a healthy discusion of this could only be good
not necessarily more regualtion than a more effictive
process of what is in place
there was many hurt in MF Global and pfg Best I hope it was not YOU
The National Futures Association accepted no responsiablity for them happening the public being
hurt WHILE tHE PRESIDENT OF THE NFA LAST YR RECIEVED ALOMOST $700,000 IN SALARY AND
COMPENSATION FOR HIS JOB !????
but least be smart /educated and discuss to help stop future problems
