Can the sheriff investigate and opponent ?

The sheriff believes that his opponent is selling drugs because the opponent has made public statements claiming to have done so.  Then the sheriff goes to the states attorney and says I want you to investigate his statements. 

Is the sheriff doing something wrong?  Isn't it his duty to protect his community and enforce the law?  Is the opponent exempt from investigation and prosecution because he's running against the sheriff?
