Irronically, the people do have a voice in this decision. They expressed their preference during the 2012 election. And yes they did elect Obama to another 4 year term.

Possibly because he was by any measure, or party affiliation, an exceptional U. S. Senator.  I'd take more from the fact that none of these goofs rose up to defend him.

Liberal justice Stephen Breyer and justice Alito both say there`s no urgency to replace justice Scalia, because justices recuse themselves all the time...well ol` Kagan SHOULD have recused herself on the gay stuff being as she performed gay weddings before they were legal.

 

Biden and Schumer refused to  HW Bush to have justice nominees in his last months as president in `92
