Re: Oil Spill
What we " think is fair" and what is supposed to happen legally can be very similar, or may be highly disparate. Other than your loat income from the land damage, you have no " standing" in forcing any sort of remedy.
The owner is the one with a perpetual problem...your family's history of leasing the land is pretty much meaningless in real terms of power of what you can demand, or even what requests will be honored by the pipeline's owner.
What you may end up with is a smaller piece of usable property going forward. The lease rate should be adjusted accordingly.

Re: Oil Spill
I would expect this will be a elongated slow process as are most " after the fact" situations ---as have seen in the news lately about the Nebraska cities receiving compensation for Atrarzine herbicide contamination of municipal water well fields--- decades in the resulting litigation although the city of Lincoln Nebraska is to be compensated @$809,000.00 alone--of course the corperate company was "not" held liable ---

I don't know yet, I left for the Ag Connect Expo this morning and haven't had a chance to look. It will have to wait until Friday.

Re: Oil Spill
That is a really good question.
I don't think you are wrong in asking for it to be replaced. I just dont' know if they would go for that.
That really sucks that it happened. Are there any kind of best practices in this situation?

Ok boys I'm gonna open up a 55 gallon drum of you know what all over your A__.
The leak itself has been repaired, but when I returned home we had 4" snow cover. Hard to check things out, and I haven't found my X-Ray goggles since we performed that last panty raid my Sr. year at college and that was in the early 90's.
Take a chill pill buy another round for your buddies and I'll keep you informed when the top dries down a bit, probably just a couple of days but I wish it were a couple of weeks.
