Here's my plan maybe I can get 50%. Take my APH for 3 crops and calculate my insurance guarantee for 1 acre using 2013 insurance guarantee's. This ground probably won't be productive for 10 years, but who knows. It's only about 1/2 acre. Take my guarantee from the 3 crops and use them each 3 times, this gives me 9 years worth of losses on 1 acre and multiply that figure by an additional 50%. Consider it my self imposed fine. This will be a rather lofty figure, but like I originally stated if I receive 50% I will be satisfied. I am calculating all figures on a 1 acre loss, but actual damage is only around 1/2 acre. Thus 50% would seem justifiable.

My own experience says that you should take plenty of pictures and document everything. Then be truthful and do not give in to them. Adverse publicity is not good for them

What you should have done...
Hindsight is 20/40, sometimes you're still wrong. But from what you said this may happen again with this guy so pay attention.
As much as you hate the idea the oil guy should have called the EPA as soon as it happened. If he will not then in the landowner's best interest you should have done it. Unless they contained everything and removed it to a proper land fill and replaced it with clean dirt you are on the losing side. You want to get the EPA involved so they don't wander in a few years down the road and demand a cleanup at yours or the landowner's expense.

Mike, I feel certain tht thete is a srlf-reporting requirement with this sort of an issue. We are required by law to report and publish in the newspaper any effluent spill of 1000 gallons or more.
I am pretty sure that most spills are not over 999...
