Claims the FAA Does Not Have The Authority To Regulate UAS

Here's a piece from Slate where the author claims the FAA does not have the authority to regulate UAS.

The arguments seems to rest on three contentions:

1.  US code does not define UAS (drone, UAV)

2.  The FAA has not taken specific steps to regulate UAS

3.  Congress did not confirm UAS authority in it's recent acts on this matter

Interesting points, but one would have to see how it would play  out in court.  In the meantime, if the FAA takes administrative action against someone, who is to stop them?
